These terms set out the rules for using Kalahari HR — what you can expect from us, and what we expect from you.

These Terms of Service govern your access to and use of the Kalahari HR platform, operated by Innovateium (Pty) Ltd, registered in Botswana (“Kalahari HR”, “we”, “us”).
By creating an account or using the service, you agree to these terms. If you are agreeing on behalf of a company, you confirm you have authority to bind that company, and “you” refers to that company.
If you do not agree with these terms, do not use the service.
You must provide accurate information when you register and keep it current. You are responsible for everything that happens under your account and for keeping your credentials confidential.
We strongly recommend enabling two-factor authentication or a passkey. Notify us immediately at support@kalaharihr.co.bw if you suspect unauthorised access.
You must be at least 18 years old to hold an account.
Trial. New organisations may start a 14-day free trial without a card. At the end of the trial you must choose a paid plan to continue using paid features.
Plans. Current plans, inclusions and prices are shown on our pricing page. Each plan has an employee limit; exceeding it requires an upgrade.
Billing. Subscriptions are billed in advance, monthly or annually, through our payment provider and renew automatically until cancelled. Prices exclude VAT unless stated otherwise.
Changes. Upgrades take effect immediately with a pro-rated charge. Downgrades take effect at the start of the next billing period.
Cancellation. You may cancel at any time from your billing portal. Your subscription runs to the end of the period you have already paid for, and is not renewed after that.
Refunds. Fees already paid are non-refundable except where required by law or where we have materially failed to provide the service.
Non-payment. If a payment fails, we may suspend access after notifying you and allowing a reasonable period to fix it.
Price changes. We may change prices with at least 30 days' notice before your next renewal.
You agree not to:
You own the data you put into Kalahari HR. You grant us a limited licence to host, process and transmit it solely to provide the service to you and as described in our Privacy Policy.
Where the data concerns your employees, you are the controller of that data. You are responsible for having a lawful basis to collect it, for informing your employees, and for the accuracy of what you enter.
You may export your data at any time while your subscription is active. After termination we retain it for 30 days so you can export it, then delete it in line with our retention practices and applicable law.
Kalahari HR automates PAYE, SDL and leave calculations based on the rates, thresholds and policies configured for your organisation. These are calculation tools, not tax, legal or accounting advice.
You remain responsible for the accuracy of the inputs you provide, for verifying results before submission, and for filing and paying on time with BURS and any other authority. We are not liable for penalties or interest arising from incorrect data you supplied, from configuration you chose, or from statutory changes you did not apply.
We aim for high availability but do not guarantee uninterrupted service on standard plans. Planned maintenance is announced in advance where practical. A contractual uptime commitment is available on Enterprise plans.

The platform, its software, design, and the Kalahari HR name and marks are owned by us and protected by intellectual property law. These terms grant you a limited, non-exclusive, non-transferable right to use the service during your subscription — nothing more.
The service is provided “as is”. To the maximum extent permitted by law, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We are not liable for indirect, incidental, special or consequential loss, or for loss of profits, revenue, goodwill or data. Our total aggregate liability arising out of or relating to the service is limited to the fees you paid us in the twelve months before the event giving rise to the claim.
Nothing in these terms excludes liability that cannot lawfully be excluded.
You may stop using the service and close your account at any time.
We may suspend or terminate your access if you materially breach these terms, if your payment remains unpaid after notice, or if we are required to by law. Where practical, we will give you notice and a chance to remedy the breach first.
We may update these terms from time to time. For material changes we will give account holders at least 30 days' notice by email or in-product. Continuing to use the service after the change takes effect means you accept the updated terms.
These terms are governed by the laws of the Republic of Botswana. Disputes are subject to the exclusive jurisdiction of the courts of Botswana. We will both attempt to resolve any dispute in good faith before starting proceedings.
